3. CLIENT RESPONSIBILITIES
3.1 Self-Management
By providing you with a control panel, ByTeX enables you to fully manage your hosting environment independently. You are solely responsible for:

– Configuring CMS platforms (WordPress, Joomla, Drupal, etc.)
– Uploading and organizing files
– Managing email accounts and forwarders
– Creating and managing databases
– Setting up FTP users and permissions
– Domain name configuration and DNS management
**Security Responsibilities**
– Maintaining strong passwords for all accounts
– Updating applications and plugins to latest versions
– Securing your website code against vulnerabilities
– Monitoring for unauthorized access
– Implementing security best practices
– Regular malware scanning and cleanup
**Backup Responsibilities**
– Creating regular backups of your website files and databases
– Downloading backups to local/off-site storage
– Testing backup restoration procedures
– Maintaining backup copies independently
**Resource Management**
– Monitoring your resource usage within package limits
– Optimizing applications for efficient resource consumption
– Upgrading your package when approaching limits
3.2 Technical Expertise Required
By subscribing to shared hosting, you represent that you possess sufficient technical knowledge to:
– Operate a web hosting control panel
– Manage website files and databases
– Configure email clients
– Troubleshoot basic hosting issues
– Implement website security measures

4. BYTEX RESPONSIBILITIES
4.1 Infrastructure Provision
ByTeX is responsible for:
**Server Infrastructure**
– Maintaining server hardware and network equipment
– Ensuring power and environmental controls at data centers
– Monitoring server health and performance
– Replacing faulty hardware components promptly
**Network Connectivity**
– Providing upstream bandwidth as specified in your plan
– Maintaining network uptime and connectivity
– Managing IP address allocations
**Base Server Software**
– Installing and maintaining the hosting control panel
– Applying security patches to server-level software
– Monitoring server-level security (kernel, Apache/Nginx, PHP, MySQL)
– Ensuring mail server functionality (SMTP, POP3, IMAP)
**Basic Server Availability**
– Keeping servers powered on and network-accessible
– Monitoring for server outages
– Restoring server functionality in case of hardware/OS failure
4.2 Limited Support Scope
ByTeX provides support strictly limited to:
– Server connectivity issues
– Control panel access problems
– Service outages (web server, database, email down)
– Account suspension inquiries
– Billing and account management
**We do NOT provide support for:**
– Website coding or development
– CMS configuration (WordPress, Joomla, etc.)
– Email client setup (Outlook, Thunderbird, mobile)
– FTP client configuration
– DNS troubleshooting beyond basic records
– Script installation or debugging
– Website errors or application issues
– Malware removal from client websites
– Performance optimization of client applications
5. PACKAGE SPECIFICATIONS
5.1 Resource Limits
Your hosting package includes specific allocations. Exceeding these limits may result in:
– Throttling of server resources
– Temporary suspension of account
– Requirement to upgrade to a higher package
– Overage fees (if applicable to your plan)
5.2 Fair Usage Policy
Shared hosting environments rely on fair usage. You agree to:
– Not consume excessive resources affecting other clients
– Not run cron jobs more frequently than every 15 minutes
– Not use shared hosting for streaming, file backup/storage, or resource-intensive applications
– Upgrade to VPS/dedicated solutions for high-resource requirements
5.3 Resource Abuse
The following activities are considered resource abuse:
– Using more than 25% CPU for extended periods
– Excessive I/O operations
– Running background processes longer than 120 seconds
– Using shared hosting for data backup/storage services
– Operating cryptocurrency miners
– Running gaming servers
6. PROHIBITED CONTENT AND ACTIVITIES
6.1 Prohibited Content
The following content is strictly prohibited:
– Illegal content under Philippine law or international law
– Child exploitation material
– Copyrighted content without license/permission
– Pirated software, nulled scripts, warez
– Hacking tools, exploit code, vulnerability scanners
– Malware, viruses, trojans, or malicious code
– Phishing pages or fraudulent sites
– Spam email services or mailing lists without opt-in
– Adult content (at our discretion, depending on plan)
6.2 Prohibited Activities
– Sending unsolicited bulk email (spam)
– Operating open mail relays
– Participating in DDoS attacks
– Port scanning external networks
– Running proxy servers or VPN endpoints
– Tor exit nodes
– IRC servers, bots, or bouncers
– File sharing/torrent trackers
– Bitcoin/cryptocurrency mining
6.3 Consequences of Violation
Violation of prohibited content/activities may result in:
– Immediate account suspension
– Termination without refund
– Reporting to appropriate authorities
– Legal action if warranted

7. BACKUP POLICY
7.1 No Backup Guarantee
**IMPORTANT: ByTeX performs backups for disaster recovery purposes only. These backups ARE NOT guaranteed and should NOT be relied upon.**
We strongly recommend that you:
– Maintain your own backups independently
– Use automated backup plugins/tools
– Download backups to local storage or cloud services
– Test your backups regularly
### 7.2 Backup Limitations
– Backups may not include all files/databases
– Backups may fail without notification
– Backups are overwritten periodically
– Restoration requests may take 24-48 hours
– Backups are not guaranteed to be restorable
7.3 Paid Restoration
If you require us to restore files from our backup system:
– Requests may be subject to a **$50 restoration fee**
– Restoration is at our sole discretion
– We are not liable for any data loss during restoration
8. FEES AND PAYMENTS
8.1 Billing Terms
– All fees are due in advance (monthly, quarterly, or annually)
– Setup fees (if applicable) are non-refundable
– Domain registrations are non-refundable
– Renewal rates may differ from introductory rates
8.2 Payment Methods
We accept payments via:
– Credit/debit cards
– PayPal
– Bank transfers (Philippine banks)
– GCash / Maya / GoTyme (if applicable)
8.3 Late Payments
– Accounts past due by **7 days**: Service suspended
– Accounts past due by **30 days**: Account terminated and data deleted
– Reactivation fees may apply after suspension
8.4 Refund Policy
– **30-Day Money-Back Guarantee** on shared hosting (new accounts only)
– Refunds do not include domain registration fees
– No refunds after 30 days
– No refunds for partial months upon cancellation
9. DOMAIN REGISTRATIONS
9.1 Domain Ownership
– You retain full ownership of any domain registered through ByTeX
– We act as registrar agent only
– Domain renewals are your responsibility
9.2 Domain Transfers
– Domains may be transferred away at any time
– Unlock domain and obtain EPP code through your control panel
– No fees for outgoing transfers
9.3 Domain Expiration
– Domains expire if not renewed by due date
– Grace periods vary by TLD (.com, .ph, etc.)
– Redemption fees may apply after expiration
– ByTeX is not liable for expired/lost domains
10. SERVICE UPTIME AND SLA
10.1 Uptime Guarantee
ByTeX offers a **99.5% network uptime guarantee** (excluding scheduled maintenance).
10.2 Credits
If uptime falls below 99.5% in a calendar month, you may request credit:
– **99.0% – 99.4%:** 5% of monthly fee
– **98.0% – 98.9%:** 10% of monthly fee
– **Below 98.0%:** 15% of monthly fee
10.3 Exclusions
Credits do not apply to:
– Scheduled maintenance (notified 48 hours in advance)
– Third-party network issues
– DDoS attacks or security incidents
– Client-caused outages
– Application/software issues
– Force majeure events
11. SUSPENSION AND TERMINATION
11.1 Suspension
ByTeX may suspend your account immediately for:
– Non-payment
– Resource abuse affecting server stability
– Security threats (compromised accounts)
– Violation of prohibited content/activities
– Illegal activities
– Court orders or legal requirements
11.2 Termination
ByTeX may terminate your account for:
– Continued violations after suspension
– Multiple or severe policy breaches
– Non-payment beyond 30 days
– Request by law enforcement
11.3 Data Deletion
Upon termination:
– All files, emails, and databases will be deleted
– Backups will be purged
– Domain may be released (if registered through us)
– We are not obligated to provide data copies
11.4 Cancellation by Client
You may cancel at any time through:
– Control panel cancellation request
– Email to billing@btx.cx
– Support ticket
Cancellation is effective at end of current billing period. No partial refunds.
12. DISCLAIMER OF WARRANTIES
**BYTEX SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES WHATSOEVER.**
TO THE FULLEST EXTENT PERMITTED BY LAW, BYTEX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
– Warranties of merchantability or fitness for a particular purpose
– Warranties of uninterrupted, error-free, or secure operation
– Warranties regarding accuracy, reliability, or completeness of any information
– Warranties that defects will be corrected
No advice or information obtained from ByTeX creates any warranty not expressly stated herein.
13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTEX SHALL NOT BE LIABLE FOR:
– Indirect, incidental, special, consequential, or punitive damages
– Loss of profits, revenue, data, goodwill, or business opportunity
– Damages from inability to use our services
– Unauthorized access to or alteration of your data
– Third-party conduct or content
– Data loss from hardware failure, corruption, or deletion
**BYTEX’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID DURING THE SIX (6) MONTHS PRIOR TO THE CLAIM.**
14. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless ByTeX, its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from:
– Your use of ByTeX services
– Violation of these Terms
– Infringement of third-party rights
– Content uploaded or transmitted through your account
– Security breaches or data loss originating from your account
– Violation of any applicable law
15. GOVERNING LAW AND DISPUTE RESOLUTION
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
15.2 Dispute Resolution
Any dispute arising under these Terms shall first attempt resolution through good-faith negotiations. If unresolved:
– Small claims: May be filed in appropriate Philippine courts
– All other claims: Exclusive jurisdiction in the courts of **Cagayan, Philippines**
15.3 Class Action Waiver
You agree that any proceedings shall be conducted on an individual basis, not as a class action or consolidated proceeding.

– Data loss, security incidents, and downtime are your responsibility to mitigate
– You possess sufficient technical expertise to operate shared hosting services
– Refunds are limited to the 30-day money-back guarantee period
– ByTeX’s liability is limited as stated in Section 13
